Is Alimony Required by Law in Every Divorce?

Posted on 06/29/201906/29/2019 by admin

When preparing for a divorce in Orange County, one of the most common concerns spouses face is financial support after the marriage ends. Many individuals assume that alimony—legally referred to as spousal support in California—is an automatic requirement in every divorce. However, spousal support is not mandatory by law, nor is it awarded in every case.

As experienced divorce and family law attorney, we help clients understand how California courts determine spousal support eligibility, how payments are calculated, and how to protect their financial future.

1. When Is Spousal Support Awarded?

Under California law, spousal support is intended to prevent one spouse from experiencing severe financial hardship following a divorce and to help the lower-earning spouse maintain a standard of living similar to what was established during the marriage.

Spousal support is generally awarded under two primary scenarios:

  • Income Disparity: There is a significant difference between the earning capacities of each spouse.

  • Domestic or Financial Sacrifice: One spouse sacrificed their own career, education, or advancement opportunities to raise children or support the household while the other built a career.

If both spouses earn comparable incomes and have similar financial assets, the court is unlikely to order spousal support.

2. Temporary vs. Long-Term (Permanent) Spousal Support

California distinguishes between support paid while the divorce is pending and support ordered after the divorce is finalized:

Support Type Purpose & Duration How Calculations Are Made
Temporary Spousal Support Maintains financial stability and covers living expenses while the divorce process is ongoing. Calculated using standard Orange County guideline formulas based strictly on net monthly incomes.
Long-Term (Post-Judgment) Support Provides ongoing support for a set period after the divorce decree is finalized. Evaluated using specific statutory criteria under California Family Code Section 4320. Formulas are not used.

3. Key Factors Judges Evaluate Under Family Code Section 4320

When issuing a final spousal support order, judges at the Lamoreaux Justice Center in Orange County must evaluate several statutory factors, including:

  • Earning Capacity & Standard of Living: Each spouse’s marketable skills, the job market, and the lifestyle maintained during the marriage.

  • Duration of the Marriage: In marriages under 10 years, support is typically awarded for a duration equal to half the length of the marriage. Marriages lasting 10 years or longer are classified as “marriages of long duration,” where courts retain jurisdiction without an automatic termination date.

  • Age, Health, and Assets: The physical condition, age, separate property assets, and debt obligations of both parties.

  • Goal of Self-Sufficiency: California law includes an explicit goal that the supported spouse should become self-supporting within a reasonable period of time.
